How Probate Works A Guide for Executors Heirs and Families Anthony S Park 9781795484244 Books Reviews
- I've never even heard of the word probate before so i could be in the minority here but i never knew that the process of handling the affairs of the deceased can be so complicated. my initial reaction towards the legal procedures was a bit bitter and virulent thinking that the courts just want to seem more important than they really are and make revenue at our expenses but, by the end of the book, i'm now actually glad the whole thing is super complex. It's really the only way to prevent bad people from stealing money from the deceased (or their friends and families). Anthony does a real good job providing examples and relatable reasons concerning this throughout the book.
The 2 topics that had my biggest attention were
1) you can decline to be the executor (person who carries out the requests made in a will) without looking like a jerk when a will states you as the executor. i never knew that there would be a legitimate reason to decline, let alone, under certain circumstances, declining is actually the nice thing to do. laziness and apathy, apparently, are not the only reasons why people refuse the requests of a deceased.
2) you can get in trouble for trying to help out (as the executor). man, whatever happened to the spirit of being a good samaritan? it's funny that i can't get in trouble for offering assistance to someone who needs help but i can get in trouble for trying to help someone who is dead. (you have to read the book, this topic was super fascinating to me)
For those of us who are nearing that age where our parents are beginning to consider these things... the wealth of information found in this little, concise, well written book is truly invaluable, for us and our family. - Whether you find yourself dealing with legalities of a recently deceased loved one or in the process of writing your will – or like me, both - this book will provide an indispensable point of reference.
In a forthright and candid approach, the book takes you through every step, document and timeframe you should expect in the probate process. I found it illuminating to find out the arduous tasks and (very often) unappreciated job that an executor/administrator has agreed to and have a newfound appreciation (and patience).
Also, as I embark on writing my will, learning how courts assess rightful ownership of assets and how they prioritize beneficiary designations has made me more vigilant about keeping my account beneficiaries and documents clear and up-to-date.
What I also found especially helpful in the book are the examples provided after each main section. Essentially, they’re short slice-of-life examples that provided a relatable situation to help clarify what I just read. - The passing of a loved one is a deeply troubling and emotional time. Often before the pain begins to subside, the 'pain' of estate settlement and legal matters present itself. Unless you are in the well prepped minority, most will be scrambling to figure out the intricacies of probate while going through it!
'How Probate Works A guide for executors, heirs and families' is a straightforward comprehensive text of probate and its process. The book cuts through the legal jargon and lays out the steps in easy to understand fashion for the average Joe. Nearly every major point is made simple through example. For such a 'heavy' topic, this manual was actually 'light' reading. It should be considered MANDATORY for all parties involved and will without a doubt proactively address many of the questions of not only probate but potential complications/delays in the journey. For a majority of folks, I would venture to say this is the only book you will every need on the topic.
